Our risk management division is directed by Judge Steven I. Platt (Ret.), a past president of The American College of Business Court Judges, and the acknowledged architect of The Maryland Business & Technology Case Management Program which has been cited nationally as a model for others to reference. Corporate Governance

Judge Steven I. Platt (Ret.) has presided and mediated over many cases where the governance of corporations, partnerships and LLC’s were issues, and he has taught other judges, as well as recruited and coordinated faculty from academia (law schools and business schools) as well the business and legal communities to further instruct other judges on these issues. He understands how Corporate Governance issues which emanate from a business organization and its culture can paralyze a company and destroy its economic vitality. We will recommend specific solutions to corporate governance issues which may stifle growth and divert the attention of management to the detriment of your company.

Litigation Prevention

Judge Steven I. Platt (Ret.) has presided and mediated over many cases involving businesses. Judge Platt understands the legal issues and more importantly the economic issues which create and drive litigation. He has neutrally evaluated as well as mediated successfully many cases both filed and unfiled which would have otherwise resulted in the expenditure of hundreds of thousands of dollars in legal fees and expert expenses. Judge Platt is supported by Nucom employees and partners with experience in systems design experience. We will assist corporate management in preventing costly litigation before it happens.

Records Retention

Nucom Consulting approaches records retention and destruction as a part of litigation prevention and cost minimization. Specific written company policies must be developed, maintained and adhered to in order to prevent litigation and, to minimize its cost and risks if it does occur. These policies are of necessity different depending on whether litigation is sought to be prevented and when it has been noticed, threatened or in fact filed. The failure to institute, properly record and follow these differentiated policies can and does carry the risk of serious legal and financial sanctions.

In order to accurately retain necessary documents, records and communications for when they are most needed, it is helpful to have discussed, drafted and implemented a structured records retention policy. This policy should define schedules, methods, and review procedures for retaining records and destroying others. An important part of this policy is making sure that records can be found and accessed, quickly and easily, using logical indexes, schematics, systems, etc. The policy should also define and explain sensitive and/or confidential information, and how it is retained.

Judge Steven I. Platt (Ret.), a principal of Nucom Consulting and one of the acknowledged architects of the Maryland Business & Technology Case Management Program helped write the protocols used by that program which preceeded and informed the adoption of the Maryland Rules of Procedure governing “Electronic Discovery”. He also served as President of the American College of Business Court Judges and as a consultant to the Sedona Conference on these issues. He has taught other judges in these capacities on these subjects.
